NEW FLORIDA WORK COMP LAW IS HURTING INJURED WORKERS

Injured workers are being screwed by Florida's workers' compensation system everyday! The Miami Herald recently highlighted one woman who developed bilateral carpal tunnel syndrome after her typing and data entry job at Office Depot. Of course, the workers' compensation carrier denied the claim.

Sadly, this injured workers and thousands of other are left without recourse because the present law makes it nearly impossible for the injured worker to hire an attorney to defend the case. Although the insurance company has no limit as to what they pay their attorneys to fight their denial, the law imposes horrible caps on the injured worker's attorneys' fee making it cost-prohibitive to take on some cases. Right now, the law says the most the injured worker's attorney can charge for a fee is between 10% to 20%. Based on the hours it takes to properly fight the insurance company for compensability, this could result in hourly fees less than minimum wage. With staff costs, insurance, and other overhead charges, such an hourly rate cannot be accepted by attorneys. Thus, leaving the injured worker without an attorney in a complex workers' compensation system.
