Injured Worker Must Live on Porch While We Fight for Benefits
He was working and supporting his family. That is until he was injured at work last February. Now, he and his wife live on someone's back porch and his kids had to find friends to live with. He now goes from church to church hoping to get food to feed him and his wife.
I wish I was making this up, but this is what one of my clients is presently going through. The workers' compensation carrier cut off his indemnity benefits last August and that started a downward spin. Despite the authorized treating doctor stating that he still cannot work, the workers' comp carrier refuses to re-instate his wage benefits. Nor is the workers' compensation carrier authorizing the surgery that their own doctor is recommending!!
Yes, we are fighting the insurance company. Yes, when we win, the workers' comp carrier will have to pay my attorneys' fees and costs. But what about now? This guy shouldn't be in the state he is in and the only reason he is is because the workers' comp carrier thumbs its nose at him.
I wish more people understood how bad Florida's workers' compensation can be. I see it, but my client has to live it! I get to go home at the end of the day. My client has no home to go to because of the workers' comp system.
Before someone starts telling you how injured workers are taking advantage of the system, stop them and tell them my client's situation. Trust me, he much rather be working than living on a porch without his daughters.
